Terms and Conditions – Sunday Style Dior Addict Promotion

 

General

1.      The Promoter is NewsLifeMedia (ABN 57 088 923 906) of 2 Holt Street Surry Hills NSW Australia 2010. Telephone number 02 8062 2434.

2.      Information on how to enter and prizes forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

3.      If there is any inconsistency between these Terms and Conditions and anything else that refers to this competition, these Terms and Conditions will prevail.

Who can enter

4.      Entry is open to all residents of New South Wales and Victoria over the age of 18 except employees and immediate families of the Promoter or Salmat Digital Pty Limited and their associated companies and agencies and participating outlets. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.

5.      Entrants into this competition must be 18 years of age or older as at the date of entry.

6.      The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity or proof of registration ownership in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

When to enter

7.      The competition commences on June 15, 2014 at 0.01AEST and concludes on29 June 2014 at 23.59 AEST.  Entries must be received by the Promoter prior to the competition close date and time.

8.      The time of entry will in each case be the time the SMS is received by the Salmat Digital Pty Limited database, not at the time of transmission by the entrant.

9.      The Promoter accepts no responsibility for any late, lost or misdirected entries including SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted.

10.    The details of how to enter the competition are set out in Sunday Style magazine, cover date June 15, 2014.


11.    Entrants may enter the competition by:

SMS cost is $0.55 per entry (including GST) whether sent during or outside the Promotion Period.  Service not available from payphones.  Participants will be required to send their personal details including, but not limited to, full name, address, state, postcode, telephone number, code-word / subscription number (if required) and answer in 25 words or less to the question “what has been your most memorable moment wearing Dior Addict”The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. Helpline: 1300 131 276. The most creative and original will win.

12.    Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these Conditions of Entry.  For the purposes of these content requirements, “entry content” includes any content (including text, photos, videos and email messages) that entrants submit, upload, transmit, publish, communicate or use in connection with their entry into the Promotion. Entries must be the entrant’s original work.  The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work.  If an entry cannot be verified to the Promoter’s satisfaction, the entry will be deemed invalid.  The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entrant’s entry.  An entrant’s entry must not include:

 

(a)   any image or voice of any other person without that person’s express consent.  Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person;

 

(b)   any content that contravenes any law, infringes the rights of any person or is potentially insulting, inflammatory, defamatory, obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and

 

(c)   any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists, unless the entrant is entitled to do so.  If an entrant has any doubts about whether they have the right to include any content (for example, recorded music) they must not include it.  By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these Conditions of Entry.

The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

13.    Any entry that is made on behalf of an entrant by a third party will be invalid.

14.    The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases.

 

Number of Entries permitted

15.    Entrants may enter as many times as they like. Only one prize will be awarded per person.

Determination and Notification of winner

16.    The winner will be the valid entry submitted in accordance with these terms and conditions that is judged by Sunday Style staff to be the most creative and original at 10:00am AEST on 31 June 2014 at NewsLifeMedia Level 1, 2 Holt Street Surry Hills NSW AUSTRALIA 2010.

This competition is a game of skill.  Chance plays no part in determining the winner.

17.    If any particular determination is scheduled on a public holiday, the determination will be take place on the following business day.

18.    The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the competition result or any other decisions the Promoter makes in connection with the Promotion.

19.    The winner/s will be notified by telephone or email within two days of being determined. Winners of prizes will be published on the Sunday Style Facebook page.

20.    Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder). 

21.    Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

22.    If the winner has not claimed the prize by 13 July 2014 then he or she will forfeit the prize and the prize will be awarded to the valid entry submitted in accordance with these terms and conditions that is judged by Sunday Style staff to be the next most creative and original at 10:00am AEST on 13 July 2014 at NewsLifeMedia Level 1, 2 Holt Street Surry Hills NSW AUSTRALIA 2010. The winner of the unclaimed prize will be notified by telephone or email within two days of the date on which they are judged to be the unclaimed prize winner. Winner/s of unclaimed prizes will be published on the Sunday Style Facebook page within 14 days of the date on which they are judged to be the unclaimed prize winner.

Prize on offer

23.    Individual prize value is up to $2,500 (including GST).  Total prize pool value is up to $5,000 (including GST) as at May 2014. One (1) winner from Sydney and one (1) winner from Melbourne will receive a luxurious afternoon of pampering for themselves and up to five friends including: 

·       High tea experience

·       Dior Prestige facial by a Dior Skincare expert

·       Dior Addict makeover, and will discover more about the creation of the new Dior Addict fragrance

24.    Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

25.    Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

26.    Prizes cannot be transferred, exchanged or redeemed for cash.

27.    It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements

 

28.    It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 

 

29.    Prize must be taken on 26 July 2014 in Sydney at 1:00pm AEST, and 2 August 2014 in Melbourne at 1:00pm AEST. In the event a winner does not take the prize at the time stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

30.    Travel must be taken at the time specified by the promoter and must coincide with the dates of the Dior events in Sydney and Melbourne. Travel must be taken between 26 July 2014 in Sydney and 2 August 2014 in Melbourne at the time specified by the Promoter and must coincide with the dates of the Dior event. If a winner and travelling companion are, for whatever reason, unable to travel on a nominated date, or do not take an element of the prize within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof.

31.    The prize is for the specified dates of the event only. If the winner (for whatever reason) is unable to travel or does not take an element of the prize within the time stipulated by the Promoter then the prize will be forfeited and cash will not be awarded in lieu of the major prize.  The Promoter makes no representations or warranties about the attendance at the event of any individuals or groups involved in the marketing of the event.

Further Terms and Conditions

32.    The Promoter (subject to State and Territory Legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.


33.    News Life Media Pty Limited, Salmat Digital Pty Limited and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

34.    If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.

35.    Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

36.    The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process. In particular, SMS entries via the internet, computer generation or “scripting” are invalid and will not be accepted. Website entries using “scripting” for multiple entries will not be accepted. The cost of sending an SMS message is the entrant’s responsibility and will not exceed 55 cents including GST. Entrants must use their own mobile phone for SMS entries. Some service providers and call plans may not provide access to Premium SMS. Entrants must ensure that all care is taken when sending messages to enter this SMS promotion. It is the entrant’s responsibility to SMS the correct number. The Promoter will not be liable for costs incurred, responses received or any other consequences of user error. Any SMS entries submitted after the promotion period has closed will not be included in the promotion and will be charged 55 cents (including GST). Entries submitted by SMS will be deemed to be received at the time of receipt by the Promoter and not the time that they were sent by the entrant.

37.    Any entrant found to be using any form of software or third party application to enter multiple times (including scripting software) will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause.  An entrant must provide any requested documentation to the Promoter upon request.

38.    Any entrant found to have used a third party (including online competition entry site) to enter on their behalf will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter.  The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.

39.    Any entrant found to be entering incorrect contact details, including incorrect email contact details, will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.

40.    If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements.Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.

41.    The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.  The Promoter and its associated agencies and companies will not be liable for any damage to or delay in transit of prizes.

42.    The Promoter reserves the right to redetermine the winner in the event of an entrant, claiming to be a winner, being unable to satisfy these Terms and Conditions.

Copyright, Statutory guarantees, Waiver and liability

43.    In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s submission, image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with News Life Media or News Limited or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.

44.    In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright and all moral rights in any material created pursuant to the winner’s submission or participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works (including modifying, adapting or publishing the entry, whether in original or modified form, in whole or in part or not at all) and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.

45.    In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.

46.    The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified.  However, the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

47.    The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

48.    All entries become the property of the Promoter. The Promoter collects personal information about you  for the purposes of conducting  this promotion but no further use of this information will be made without prior consent.

49.    All entries become the property of The Promoter. All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.

50.    Salmat Digital Pty Limited, on behalf of News Life Media Pty Limited, is collecting the entrant’s personal information for the purpose of conducting and promoting this competition (including but not limited to determining the winner). If you are not willing for this to occur you cannot participate in the promotion.

51.    Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.


52.    The Promoter collects information about you, including for example your name and contact details which you provide when registering or using our services as well as information from data houses, social media services, our affiliates and other entities you deal or interact with for example by using their services.  We collect and use that information to provide you with our goods and services, to promote and improve our goods and services, to provide you with targeted advertising based on your online activities, for the purposes described in our Privacy Policy and for any other purposes that we describe at the time of collection.  We may disclose your information to our related companies, including those located outside Australia.  Any of us may contact you for those purposes (including by email and SMS) at any time.  We may also disclose your information to our service and content providers, including those located outside Australia.  If you do not provide us with requested information we may not be able to provide you with the goods and services you require.  We may disclose your personal information to authorities if you are a prize winner or otherwise as required by law. Terms and Conditions – Sunday Style Style Sessions Beauty Pack competition

1. Information on how to enter and information on the prizes that may be won in the Sunday Style #SundayStyleLoves Competition (from the Weekend Edition Event) form part of these terms and conditions.

2.     Entry into this competition is deemed to be an acceptance of these terms and conditions.

3.     To enter this competition, entrants must:

a)     Attend the Mercedes Benz Fashion Week Weekend Edition event, at Carriageworks Redfern on April 12, 2014 – April 13, 2014.
 

b)     Share a picture of their experience at the Sunday Style sessions using the social media hashtag #SUNDAYSTYLELOVES across Facebook, Twitter or Instagram.


i). Before sharing their picture, entrants must ensure the privacy settings for their social media accounts are set to “public” to enable that picture to be viewed by anyone; otherwise the entry is not valid.

4.     The competition commences on April 12, 2014 at 9:00am AEST and concludes on April 14 at 12:00pm AEST. Entries must be received by the Promoter prior to the competition close date and time.

5.     The entrant must own the copyright, or have express permission from the owner of the copyright, to use any photographs that form part of their entries in the manner contemplated by these terms and conditions.

6.     Entry in this competition is open to Australian residents only (aged 18 years and over). Employees and their immediate families of the Promoter, its related entities and agencies associated with this promotion are ineligible.

7.     There will be one major, determined by Sunday Style editor-in-chief Kerrie McCallum based on the creativity and quality of the entries. Only amateur photography will be accepted and entry must be the work of the participant. The decision is final and no correspondence will be entered into.

8.     This is a game of skill and chance plays no part in it.

9.     The competition will be judged on April 14 2014 at 2pm (AEST) at NewsLifeMedia, 2 Holt Street Surry Hills, NSW 2010. If a winner is under the age of 18 years the prize will be awarded to their parent or legal guardian.

10.  The winners will be announced at https://www.facebook.com/#!/sundaystyleau.

11.  The winners will be notified by email or via social media, depending on the method of entry used by the winner to enter the competition. The winners must supply to the Promoter an Australian mailing address for the prize/s to be delivered by 28 April, 2014. If the winners does not contact the Promoter by close of business on 28 April, 2014, the winners is deemed to have forfeit the prize/s and another winners for the competition will be chosen based on the criteria set out in these terms and conditions.

12.  By entering this competition, entrants consent to their entries in the form of photographs being published in Sunday Style magazine or any other publication as the Promoter determines. The entrant grants the Promoter a perpetual, worldwide, royalty-free licence to publish, produce, distribute and communicate the images of the original entry in taste.com.au magazine or any other publication as the Promoter determines, for the purpose of publicising and promoting the taste.com.au brand and taste.com.au competitions.

13.  By accepting the prize, the winner agrees to participate and cooperate as required in all editorial activities relating to this Sunday Style Loves competition.

14.  One (1) major competition winner will receive the following as their prize:
A beauty pack, containing a variety of fragrances, skin care and make up products, valued at $500.00 


15.  Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. All prize values are in Australian dollars. The Promoter accepts no responsibility for any variation in the value of the prizes.

16.  Prizes will be delivered to the winner within 3 months of the winner notifying the Promoter of their Australian mailing address. Delivery within Australia, not installation, is included with all prizes. Prizes are not transferable or redeemable for cash.

17.  Once the prize has left the Promoter’s premises, the Promoter is no longer responsible for any late or misdirected prizes other than due to the negligence of the Promoter.

18.  The Promoter reserves the right to substitute any prize with a prize of equal or greater value if the prize is for some reason unavailable and subject to gaming authority approval.

19.  It is the entrant’s responsibility to advise the Promoter of any change of personal details. The Promoter reserves the right to request the winner to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.

20.  Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to the acceptance of the prize.

21.  The Promoter is not liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries that are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid. Further, the Promoter is not liable for technical, hardware, or software failures of any kind or lost or unavailable network connections which may limit or prohibit an eligible entrant’s ability to participate in this Cook the Cover competition.

22.  Competition entrants acknowledge that this promotion is in no way sponsored, endorsed, administered by or associated with Facebook, Twitter or Instagram.

23.  If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion.

24.  The Promoter does not exclude any rights and remedies in respect of goods or services under the Competition and Consumer Act 2010 (Cth) or equivalent State or Territory legislation which cannot be excluded, restricted or modified. However, the Promoter exclude all rights, remedies, guarantees, conditions and warranties in respect of goods or services from an entrant’s entry into this competition whether based in statute, common law or otherwise to the extent permitted by law. To the fullest extent possible, competition entrants agree to exclude the Promoter (including its officers, employees, agents and related bodies corporate) and Facebook from all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third-party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

25.  The Promoter collects information about you, including for example your name and contact details which you provide when registering or using our services as well as information from other sources. We collect and use that information to provide you with our goods and services and to promote and improve our goods and services. We may share your information with our related companies and any of us may be in contact for those purposes (including by email and SMS). We may also use your information as described when we collect information from you. If you do not provide us with requested information we may not be able to provide you with the goods and services you require. We disclose your information to our related companies, service and content providers, including those located outside Australia. Where you have entered a competition, we may disclose your personal information to authorities if you are a prize winner or otherwise as required by law. 30.    Prize must be taken on February 14, 2014. In the event a winner does not take the prize by the time stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

 

31.     The flight portion of the prize/s is not available to a winner if a winner resides in the same state as the state in which the event that forms part of the prize takes place.

 

32.    Event tickets are only valid for the date or period specified on the tickets or by the provider, and are subject to any terms and conditions imposed by the provider.  Once awarded, the Promoter is not liable for any ticket that has been lost, stolen, forged, damaged or tampered with in any way.

 

33.    The winner/s (and their companion/s) is/are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.  Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.  The winner is responsible for ensuring that they and their travelling companion(s) are fit to travel and have received appropriate immunisations and/or health checks prior to taking the prize.

 

34.    The winner/s and travelling companion must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Melbourne).  If the winner resides in NSW then the flight component of the prize will not be included and the winner and their travelling companion will responsible for making their way to and from the QT Sydney.

 

35.    The prize must be taken on February 14, 2014 and is subject to hotel and flight availability. The prize cannot be changed once the booking has been made.  Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule.  Frequent Flyer points are not available from any airline.  A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.

 

36.    Travel must be taken at the time specified by the promoter and must coincide with the dates of the Valentine’s Day Evening at the QT Sydney.. If a winner and travelling companion are, for whatever reason, unable to travel on a nominated date, or do not take an element of the prize within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof.

 

37.    The prize is for the specified dates of the event only. If the winner (for whatever reason) is unable to travel or does not take an element of the prize within the time stipulated by the Promoter then the prize will be forfeited and cash will not be awarded in lieu of the major prize.  The Promoter makes no representations or warranties about the attendance at the event of any individuals or groups involved in the marketing of the event.

 

38.    The Promoter does not guarantee that the celebrities, actors and/or production staff associated with the prize will be present during the visit or that the winner will meet any of them. Travel must be taken to coincide with the timing of the prize, on a date to be determined by the Promoter at its discerion. The winner agrees to abide by, and ensure his or her companion abides by any reasonable requests made by the Promoter. If the winner does not comply with such requests that winner may be removed from the venue.

 

All winners are advised that the allocated classification guidelines for each film must be adhered to as per usual standards set out by the film Classification Board and associated domestic legislation.

 

39.    Legal aged consumers should be advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines that are available at: http://www.alcohol.gov.au/. Participation in this promotion is subject to relevant liquor legislation in each State, Territory or Country, including responsible service of alcohol. Further Terms and Conditions

 

40.    Subject to complying with all relevant State and Territory legislation, the Promoter reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of the competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.

42.    If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.

44.    If an entrant uses any form of software or third party application to enter multiple times (including scripting software), organises for a third party to enter on their behalf in breach of these terms and conditions or enters using incorrect contact details, his or her entry will be deemed invalid. 45.    If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.

 

46.    The Promoter will make reasonable efforts to deliver prizes to the addresses provided by competition entrants. 49.    Each entrant hereby assigns to the Promoter all right, title and interest in and to all copyright and all moral rights in any material created or otherise submitted to the Promoter in connection with that entrant’s entry or participation in any aspect of the prize (Works). Each entrant warrants that the Promoter is free to use the Works (including modifying, adapting or publishing the entry, whether in original or modified form, in whole or in part or not at all) and to exercise its rights in relation thereto and neither the entrant nor any third party will be entitled to any fee for such use.

 

50.    In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.

 

51.    The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified.  However the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. 26.    Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

 

27.    Prizes cannot be transferred, exchanged or redeemed for cash.

 

28.    It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.  It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties.

 

29.    It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 

 

30.    All entrants agree that if they win the prize, they will not, and their companions will not, sell or otherwise provide their story and/or photographs to any media or other organisation, including the internet. Photographs will be allowed only at the discretion of the Promoter.

 

31.    Prize must be taken by December 2014. In the event a winner does not take the prize by the time stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

 

32.    Event tickets are only valid for the date or period specified on the tickets or by the provider, and are subject to any terms and conditions imposed by the provider.  Once awarded, the Promoter is not liable for any ticket that has been lost, stolen, forged, damaged or tampered with in any way.

 

 

33.    The winner acknowledges and accepts that activities that form part of the prize are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur take placeThe winner must make his or her own enquiries about local issues and conditions at destinations prior to travel.

 

34.    The winner/s (and their companion/s) is/are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.  Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.  The winner is responsible for ensuring that they and their travelling companion(s) are fit to travel and have received appropriate immunisations and/or health checks prior to taking the prize.

 

35.    The winner/s and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide or Perth).  (If the winner is from Tasmania, ACT or NT connecting flights from these cities to the nearest flight departure capital city will be included in the prize package for the winner and travelling companion only – if applicable).

 

36.    The prize must be taken by December 2014 and is subject to hotel and flight availability. The prize is not available during peak times such as public holidays and school holidays (if applicable) and cannot be changed once the booking has been made.  Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule.  Frequent Flyer points are not available from any airline.  A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.

 

37.     The winner and his or her travel companion are responsible for complying with health and any other government requirements that may apply to the prize. All prize travel will be subject to the carrier’s General Conditions of Carriage. It is the traveller’s personal responsibility to ensure that they have valid documentation, including valid passports and visas, which meet the requirements of government authorities at the relevant  destinations. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.  The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. Entrants should obtain travel advice from independent sources, such as the web site of the Australian Department of Foreign Affairs and Trade.

 

38.    The winners acknowledge that regions of Mexico are politically unsettled, and guerrilla warfare/activity is still known to exist in the areas in which they will be travelling. The winners are required to be physically fit. This expedition/prize is not suitable for anyone who suffers from a respiratory disorder, circulatory ailment, or physical disability that limits mobility. By entering the competition, the winner and their guest acknowledge they are able to bring with them with the required clothing for this tour at no expense to the Promoter or the other organisers.

 

39.    Travel must be taken at the time specified by the promoter. Travel must be taken between times specified by the Promoter. If a winner and travelling companion are, for whatever reason, unable to travel on a nominated date, or do not take an element of the prize within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof.

 

 

40.    All winners are advised that the allocated classification guidelines for each film must be adhered to as per usual standards set out by the film Classification Board and associated domestic legislation.

 

 

Further Terms and Conditions

 

41.    Subject to complying with all relevant State and Territory legislation, the Promoter reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of the competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.

 

42.    The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

 

43.    If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.

 

44.    Entrants are responsible for any cost associated with accessing the promotional website Access to that site is dependent on the Internet service provider.

45.    If an entrant uses any form of software or third party application to enter multiple times (including scripting software), organises for a third party to enter on their behalf in breach of these terms and conditions or enters using incorrect contact details, his or her entry will be deemed invalid. If such an entrant wins a prize, the entrant must immediately return the prize to the Promoter.  The Promoter has sole discretion to determine whether an entrant has breached this clause. The Promoter reserves the right to request whatever documentation it deems necessary to confirm whether an entrant has breached this clause. Entrants must provide whatever documents the Promoter requires upon request.

 

46.    If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.

 

47.    The Promoter will make reasonable efforts to deliver prizes to the addresses provided by competition entrants. If a prize is returned to the Promoter because it could not be delived to the address provided, the Promoter cannot guarantee that it will be able to resend the prize to the prize winner.  The Promoter and its associated agencies and companies will not be liable for any damage to or delay in transit of prizes.

 

48.    The Promoter reserves the right to redetermine the winner if an entrant who claims to be a prize winner is unable to satisfy these terms and conditions.

49.    In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s submission, image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with News Life Media or News Limited or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.

 

50.    Each entrant hereby assigns to the Promoter all right, title and interest in and to all copyright and all moral rights in any material created or otherise submitted to the Promoter in connection with that entrant’s entry or participation in any aspect of the prize (Works). Each entrant warrants that the Promoter is free to use the Works (including modifying, adapting or publishing the entry, whether in original or modified form, in whole or in part or not at all) and to exercise its rights in relation thereto and neither the entrant nor any third party will be entitled to any fee for such use.

 

51.    In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.

 

52.    The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified.  However the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. Terms and Conditions

1.     Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

5.     To enter, participants must during the Promotion Period.

a)     Instagram Entry: Entries are to be submitted via uploading a Sunday Style inspired image with the accompanying hashtag ‘#sundaystyleloves’ and ‘@SundayStyle’

6.     Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.

10.   Entries must be received by 17:01 (AEDT) on Friday 6th September 2013. The time of entry will in each case be the time the Instagram post is received via the Promoter’s Instagram account. 1.    Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

2.    Entry is open to all residents of Australia. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.

4.    The competition commences on Sunday 21st July 2013 at 9am (AEST) and concludes on Monday 29th July 2013 at 9:00 (AEST).

6.    To enter, participants must complete the following during the Promotion Period.
